come out and as we know from the diddy trial and all these other high-profile cases it is not going to stop them from impounding injury. it may take longer and there might be appellate issues because there are cases where they think that the panel jurors who were had pretrial publicity exposure. the e end of the day, they will impanel as much of an impartial jury as they can. >> john: and the fact of the death penalty on the table, i think the judge wants to make sure that this goes forward smoothly as possible. and the defenses job i guess is to try to derail the proceedings they threw a wrench into them earlier this week. what they suggested that there is an alternate suspect that investigators should be looking at. is about the new post what about it. the judge is telling lawyers to name the suspect and offer up any actual evidence they have against him. he said with -- what attends attorneys was injured -- objectionable.

we're going to see this case to the end. >> given the preponderance of evidence, lexi can the defense raised this idea of an alternate suspect. >> they are going to try and there's a big difference between saying there's a smokeout, it cannot -- versus saying, was bob smith. whoever bob smith was making up a name. that is the difference. they. they can just put me into some specific person and say it was him and ambush the prosecution of the topic they have to have some type of evidence and the need to disclose things to the prosecution order to do that. that is no different than other defenses that they have tried such as alibi. he can't just bring it out of the trial. it is an interesting theory. it is being raised very late as we know that the trial is scheduled for august. but they also said recently that this is based on a tape. and so we will see. and we will also see if this ends up delaying the trial.

louisiana. there's no question about there. a full scale press men had underway to try to get these inmates back because as you pointed out, sandra, some of them are very dangerous. we don't know if they have managed to arm themselves since their escape. you can bet given what they were in jail for that they are people that you don't want to encounter. >> sandra: okay, so a little bit more information from the sheriff's office on the one captured inmate, candle mouse. currently back in custody. he is being rebuilt at the facility for a new charge of what they are coming simple escape. that deputies found him hiding underneath a car at a local hotel on broad street. he was in a parking garage at the hotel, john. he was then transported back to the jail by the louisiana state police. the remaining individuals are still being actively pursued and are deputies in collaboration with local and state law enforcement are working tirelessly to locate and return them to custody.

rolling into north carolina for competition unlike any other. our madison alworth live from north wilkesboro speedway. what impact does the race we have on local businesses? i'm sure it is pretty grand. >> it is huge. local business owners are thrilled to see this activity on the track. cars here and fans in the stand. this racetrack is actually older than the sport of nascar itself. for 30 years, it was abandoned, completely empty. it was a mess and then they revived it and now we are back in town for the third annual all-star race. it is better than ever. we are expected fans from 43 states and nine different countries all here this weekend because of that, nascar has automatically brought a lot of business. locals like seth coleman who owns multiple restaurants, actually able to open a new location this year because of that expanded business. and it is also loved by the drivers because so many of them
